Fraction of the Femur, Tibia, Pelvis, or Tarsal Bone
Many claimants come to the SSA with broken bones and generally the result is the same – the claimant is denied benefits because the bone is likely to heal with minimal complications. This is true even for claimants with multiple breaks. The only way a claimant will be awarded benefits from broken bones is to show a history of slow recovery. The claimant must prove the bone is likely not going to fully heal within 12 months of the surgery. Children are treated the same way.
- An x-ray or other imaging technique must confirm the failure of your fracture to heal; AND
- An inability to walk and move around effectively, with no expectation that you will be able to walk and move around effectively within 12 months.
