There are specific conditions that apply, which could affect the survivor’s ability to collect benefits. For example, if the deceased was also insured by the Railroad Retirement system, you may qualify for those benefits instead. You also may not qualify for benefits or may receive smaller benefits, if either the deceased or you have claim tax exemption because of religious involvement. Additionally, if you are responsible for the death (convicted) of the insured person, you will not be entitled to any form of benefits or a lump-sum payment on the record of the deceased.

To be classified as a widow or widower you must meet specific guidelines as allowed by the social security administration. According to the social security administration, to receive survivor benefits you and the deceased must have had a valid marriage or would be classified as a widow or widower in regards to personal property distribution. You should contact your Phoenix disability attorney or advocate to better understand the requirements and to find out if you meet them.

Additionally, the child must not be married, and must have been dependant upon the parent that is deceased, and an application for benefits must be filed with the social security administration. For a stepchild to claim survivor’s benefits, they must have been the stepchild of the decease for at least nine month
